| 摘 要： | 当今社会,著作权已经成为一种重要的财产权利,而质权制度则是对著作权利用的一种重要方式。但由于著作权的二元结构,在质权行使的过程中,著作人身权与财产权会分属不同权利主体,从而造成权利冲突。在维护质押权的基本法律原理和著作权二元结构之下,法律应通过著作人身权自我限制和合理限制来解决质权与著作人身权之间的权利冲突。

| Abstract: | Today,copyrights is very important property rights. People can make use of copyrights by pledge.In fact,because the property rights and the moral rights is owned to different persons in the process of pledge,so the conflictions between of pledge and copyrights owners is appeared.To solve this problem has two ways: First,through the contracts to limit the moral rights of copyrights owners;second,through the fair use to the moral rights to limit the moral rights of copyrights owners. |
