| 摘 要： | 我国的审前羁押制度由于结构上的缺陷 ,在适用过程中引发了大量的超期羁押和刑讯逼供 ,对审前羁押制度进行改革的呼声日益高涨。我国应当逐步建立羁押分流制度、捕押分离制度、羁押的司法审查制度及侦查机关与看守机关的分离制度。

| Abstract: | Because of the deficiency in structure of Chinese pretrial detaining system,many overtime detaining and using tortures to coerce a statement appeared in application. It is highly demanded to reform pretrial detaining system. We should establish distributary detention system,separated arresting system,judicial investigation system to detention and separated system of investigation organs and detention house. |
