谈检察业务决策机制

现行检察业务决策机制可以简单地概括为双轨多元制,它的形成与中国政治体制、传统法文化观及检察人员素质较低密切相关.然而现行检察业务决策机制表现出的司法职能背离、效率的减损及科学决策缺失决定了对其进行重构成为必然.未来检察业务决策机制应以检察官、检察长、检委会三元负责制,专家咨询制,及内外结合监督制为内容的模式.近期目标则是要强化主诉、主办检察官职能,细化检察长职责,优化检委会议事职能.而这些改革离不开检察官精英化,增强职业保障和完善责任追究制等配套措施进行.

On Decision-making Mechanism concerning the Procuratorial Work

Current decision-making mechanism in the procuratorate may be generalized as a double track pluralistic system as a result of the political system, traditional legal culture and lower-quality of the procuratorial personnel, while there is necessity to reconstruct this mechanism because of the deviation of the judicial function, reduction of the efficiency and lack of rational decision-making. Based on Chinese actual situation and consulting relevant system abroad, the intending decision-making mechanism concerning the procuratorial work should be the combination of triple-responsibility system dividing the responsibilities of the prosecutor, the chief prosecutor and the procuratorial committee, expert-consulting system and inside-outside integrated supervision system. The object in the near future is to intensify the function of different prosecutors and the reform still needs corresponding measures.
