| 摘 要： | 合理的刑罚结构是实现宽严相济刑事政策的基础,文章主要从以下四个方面探讨了在宽严相济刑事政策要求下,如何完善我国刑罚体系中的自由刑：一、无期徒刑;二、有期徒刑;三、管制;四、增加社区矫正刑。文章并针对刑罚制度的弊端,提出了修改的建议和措施,以更好地体现宽严相济刑事政策的要求,实现刑罚现代化。

| Abstract: | Reasonalbe sentence structure is the basis of the criminal policy of tempering justice with mercy.This article discusses how to perfec the punishment against freedom from four aspects under the demands of criminal policy of tempering justice with mercy：imprisonment;life imprisonment;control;community correction.In accordance with the disadvantages of penal system,this article puts forward the revision suggestions and measues to embody the demands of criminal policy of tempering justice with mercy and realize penal modernization. |
