| 摘 要： | 2005年1月10日,国务院公布了新的<信访条例>,并于5月1日开始正式实施.本文分析了新<信访条例>的主要特色及不足,认为新<信访条例>的颁布实施,仅仅是信访制度改革的新起点,后续的改革应该与政治体制改革联系起来,采取渐进方式实现以法治为内容的信访制度,取消"人治"信访,从而逐步走出目前的信访困境.

| Abstract: | The State Council of China announced the newly- amended Regulations on Letters and Visits on Jan 10, 2005, which came into effect on May 1. This paper analyses the main characteristics and drawbacks of the newly- amended Regulations and holds that the publication of the newly- amended Regulations is just a beginning of reforming the appeal system, which should be related to the reform of political system. The subsequent reform should gradually adopt an appeal system that is regulated by law, not by men. This should help tackle the dilemma of appeal and petition. |
