Study on the Right of the Freedom of Scientific Research

The freedom of scientific research is dualism: being a mental freedom, it is a negative right; being a physical freedom and social cultural right, it is a positive one. As a positive right, freedom of scientific research needs the guarantee of material and legal system. This determines that the basic value-orientation of science and technology legal system is to guarantee the freedom of scientific research. To guarantee the freedom of scientific research, we need to analyze its configuration. The right of scientific freedom consists of the rights to choose freely the research subjects, to undertake freely the scientific research activities, and to express freely academic ideas. The integration of the three rights constitutes the comprehensive right system of freedom of scientific research.
