On the Evolution of Punitive Damages in American Maritime Law

This article first tries to supply a more accurate and balanced historical account of punitive damages in America and introduces the different treatment among legislative bodies, courts and scholars. This article then discourses upon punitive damages in American maritime law in different periods since the pre-Jones Act. The history and analysis show that America will restrict or eliminate the right of maritime actors to seek punitive damages.
