论法权制度的传统缺陷及其现实基础

由于传统法权制度存在着整体意志与个体自由相冲突的缺陷和矛盾 ,从而使它无法从现实而合理的角度出发 ,既维护社会整体的基本利益 ,又满足社会个体的自由愿望。而以法权理性为核心的现代法治社会 ,只有进一步克服了这些矛盾和缺陷 ,才有可能从根本上既维护社会整体的基本利益 ,又能够实现社会个体自身的权利追求和自由主张。本文正是着眼于此 ,在对传统法权理性进行分析的基础上 ,提出了现代法权制度能够得到根本实现的基础和依据。

The Traditional Shortcoming And Actual Foundation Of The Right Institution

Since the traditional right institution has the shortcoming of a confliction between the whole will and the individual freedom so as not to maintain and fulfil both benefit and wish,therefore,it is left to the modern society of rule by law,which has the right reason as its core,to overcome the shortcoming in order to achieve the objects above said.According to this,in this paper,the foundation and ground the modern right institution can be put into an actual effect,is set up by the analysis of the traditional right reason.
