| 摘 要： | 对人民陪审员的科学定位是完善人民陪审制度的状键.<关于完善人民陪审员制度的决定>对人民陪审员的价值、选任标准、诉讼职能等问题作出了更加明确的规定.对于参与案件审理活动的人民陪审员而言,其职责就是参与法庭审理活动,并按照法律的规定履行职责,民主和监督是隐含在其行为背后的功能.对人民陪审员的准确定位有助于其作用的发挥,实现人民陪审员在民主社会中的全部价值.

| Abstract: | The scientific location of The People's Juror is the vital to reform the system of The People's Jury.The value,the selected standard,the procedural function and the character in society of The People Juror are located anew in.The responsibility of The People Juror,who participates the judge of case,is participation and carrying out obligation abiding by the law.Both democracy and supervision are beyond his action.So accurate location of juror is benefit to exert his function and accomplish the value in the democrat society. |
