纽黑文学派：冷战时期国际法学的一次理论创新

二战结束随之而来的冷战紧张对峙局面,对于国际法乃至国际法学的发展极端不利。同时,这个时期占据国际关系理论与实践主导地位的现实主义学说,不仅否定了国际法的独立性,也对国际法的作用极端贬低,从而对国际法的理论与实践造成很大的冲击。面对这种困境,国际法学试图在理论上寻求突破,"纽黑文学派"(the New Haven School)即是典型。不过,虽然"纽黑文学派"的理论变通使得国际法在冷战时期权力斗争之背景下取得更大的作用空间,但这种变通的消极意义也不能被忽视。

New Haven School: A Theoretical Revolution of International Law in Cold War Period

The cold war impasse following the World War II posed as a great challenge to international law and the relative research.In the same time the predominant school of realism of international relations not only denied the independence of international law but also belittled the role of international law,which constitute a major impact on theory and practice of international law.Faced with this challenge,the scholars of international law especially the school of New Haven tried to make a breakthrough.Though the alternative method of New Haven paves a new way for the international law against the background of power struggle of cold war,the negative side thereof can't be ignored.
