论中国社会转型期的社区矫正制度

起源于英美国家的社区矫正制度,移植我国本土的时间不长,但作为一种具有人性关怀执法理念的行刑方式,在构建和谐社会的背景下,却大有推广应用价值。中国正于处于社会转型期,这期间的社区矫正工作必须量国情而行。既要准确认定社区矫正的内涵与价值,又要实事求是地客观分析中国现状。只有如此,才能构建出切实可行的中国社会转型期的社区矫正制度。本文分三部分对上述问题逐一展开了论述。

On community correction system in social transition

The community correction system which was originated from the United Kingdom and the United States, has been transplanted to China for not a long time. But as a execution way with the notion of humane care, under the background of building a harmonious society, it is worth spreading and applying. China is in the period of social transition, during which the community correction must go with the situation of the country. We should not only define the meaning and value of Community Correction accurately, but also give realistic and objective analysis on the present situation of China. Only by doing so can build a feasible community corrections system in social transition. This paper is divided into three parts to discuss each of the above problems.
