| 摘 要： | 我国现行国家赔偿法已颁行十余年,既发挥了重要作用,也日益显现出缺陷与不足。国家赔偿法的直观缺陷表现在赔偿范围狭小、赔偿标准低等方面,而深层次的原因在于立法理念落后和基本原则缺位。应将修订国家赔偿法,改革和完善国家赔偿制度的突破口选择在基本原则的创新上,并在此基础上重新设计国家赔偿的相应制度。

| Abstract: | The state compensation system of China has been operating for more than 10 years.In this process,prelimi- nary effect is achieved and many problems is exposed.The state compensation legal system will produce profound changes. The paper firstly introduces the mistakes and shortcomings of the current system are analyzed.Thirdly,the paper explores the innovative trend of state compensation system in the future from the angles of the purposes and principles of this law,the establishment of rules and the establishment of state compensation security system. |
