| 摘 要： | 刑事诉讼中举证责任倒置对被告来说不只是责任也是维护自己合法权利的权利。举证责任倒置在刑事诉讼中作为我国司法证明规则的一项新的课题,需要从理论和实践中去探索,从法律上加以明确规定,只有这样,它才能在刑事诉讼中起到积极的、有益的司法作用。

| Abstract: | Burden of producing evidence inverting is not only the responsibility to defendant,but also the right of protecting their own legal right.As judicial testimonial principle in our country,burden of producing evidence inverting is a new task in criminal lawsuit.It needs studying in theory and practice,formulating specifically in law.It could be active and effective in criminal lawsuit only in this way. |
