干股受贿若干问题探讨

干股受贿的隐蔽性和危害性已经人所共识，可刑法理论的失语和刑事惩罚的失效难以与国家惩治腐败的力度相适应。为此，最高人民法院、最高人民检察院2007年7月颁布了《关于办理受贿刑事案件适用法律若干问题的意见》，初步统一了对干股受贿理论与实践上的模糊认识。为加深和扩展研究，对于千股受贿犯罪特定语境下的股份价值、受贿数额、受贿未遂等问题本文特别加以厘清。
