浅论片面共犯问题

片面共犯作为共同犯罪的一种特殊形态,因其相对隐蔽性但又相当严重的社会危害性,引起了刑法理论界的重视.但由于分析时所站的角度不同,所持的观点也不同,目前存在着否定说和肯定说之争.在肯定说中,对肯定的范围也不一致.通过哲学、刑法理论等多方面的论证可得出,片面共犯是成立的,片面共犯成立的范围为片面组织犯、片面教唆犯以及片面帮助犯.
