海峡两岸毒品犯罪比较研究

两岸刑法在毒品概念、分级制度、毒品犯罪对象和行为类型等方面存在较大的差异。大陆刑法在毒品犯罪对象、行为类型等方面有着较为完整的规制体系，台湾“刑法”在毒品分级制度和使用行为犯罪化问题上迥异于大陆刑法。研究还发现，台湾“刑法”的毒品分级制度、毒品目录更新机制、对制毒设备和施用毒品的器具的刑法规制值得大陆刑法借鉴。

A Comparative Investigation of Drug Crime in Taiwan Region and Chinese Mainland

There exist significant differences in drug concept,grading system,object and behavior type of the drug crime etc.in penal laws of Taiwan Region and Chinese Mainland.The objects and behavior types of drug crime etc.in penal law of the Mainland have been prescribed more completely than Taiwan Region's.As to the drug crime grading system and the criminalization of using behavior,there are absolute differences in the penal laws of Both Straits.The research also finds that it deserves the penal law of the Mainland to study the grading system,the renewal mechanism of drug catalogue,and the provisions of making poisonous equipments and appliances of narcotic addict prescribed in penal law of Taiwan Region.
