| 摘 要： | 受教育者申诉制度是由《中华人民共和国教育法》确定的、以维护受教育者合法权益为目的重要制度,但在立法上仍存在很多疏漏。只有认真解剖和分析现行立法当中存在的问题,重新设计立法模式、完善立法内容,并在立法当中正确处理受教育者申诉制度与诉讼机制的关系,才能发挥这一制度在保障和救济受教育者合法权益当中的作用。

| Abstract: | The educatee apeal system is stipulated by Law of the People's Republic of China on Education,It is an important method to protect the legal interests of educatees,but the legislaton has many defects.If we hope to bring the educatee appeal system into play,we must design the mode and contents of legislation again,and correct the relationship between the educatee appeal system and litigation system. |
