军事立法的经济学分析

军事立法关乎国家、政府、军队、社会组织和个人多个权利主体的利益,所体现的权利和义务关系具有复杂性和多样性。军事法律制度要蕴含合理的经济理性,需要应用资源的稀缺性、主体行为的外部性和主体资源的有限性、主体诚信有限性等有关经济学理论来反映社会经济关系赋予军事法律制度的规定性。军事立法的经济学分析路径应遵循以下几个方向：军事权力与军人权益配置效率最大化,军事法律责任预防最优化,军事法律程序成本最小化等。这样研究的目的是达到：军事行为主体的对策行为均衡以促进合作、保障合作,军事立法多目标博弈均衡。

Economic Analysis on Military Legislation

Military legislation embodies a complicated relation of rights and obligations with which the interests of multi parties such as the government, armed forces, social organizations and all citizens are concerned. Military legal system should comprise a reasona- ble economic sense and reflect the prescriptive function of military legal system imposed by social economic relations by application of such economics theories as rareness of resources, externality of agent behaviours, limitation of legislation bodies and their honesty and credit. An economic analysis on military legislation should keep to the following paths： efficiency maximization on the configuration be- tween military power and the rights and interests of service men; optimization to the most of precaution of military legal liability; and minimization of procedural cost of military legal system. The target of such research is to promote and guarantee cooperation among the countermeasures of military behaviour agents, and to achieve a balance between the multi objectives in military legislation.
