侦查权若干问题研究

关于侦查权的主体 ,就世界各国的整体情况看 ,将刑事案件的侦查部门设置于警察机构之中几乎是一种被普遍采用的模式 ;笔者对“检、警一体化”的制度设计心存疑惑。关于侦查权的范围 ,我国《刑事诉讼法》列举的侦查权遗漏了询问被害人、侦查实验、辨认、查询冻结、秘密侦查等项 ;强制措施具有侦查的性质 ,预审也同样具有侦查的性质。关于侦查权的制约 ,应包括内部、外部制约两方面 ,当前更应从以权力制约权力 ,以权利制约权力 ,设立非法证据的排除规则 ,实行拘留、逮捕权与羁押权的分离 ,设立司法救济制度等方面加强外部制约机制的建立。

Study on Several Problems of Investigative Powers

About the subject of investigative powers,in the worldwide,investigative organs for criminal cases are set in police departments,which is a common model accepted.Author is not sure of the system of integration police with prosecutor.About the scope of investigative power,There are not questioning victims,identify,inquiry and freeze,clandestine investigation on investigative authority listed in The Criminal Procedure of China.About the check of administrative powers,including inside check and outside check,now the mechanism of outside check should be especially stressed to check power by power,check right by right,separate detain,arrest from custody,and to set up juridical review.
