| 摘 要： | 本文从完善赔偿立法的本愿出发，将赔偿法在检察实践中遇到的诸如检察监督权在赔偿法中的地位、检察机关受理赔偿案件的程序、办理赔偿案件应适用的法律标准、存疑案件的赔偿原则、应纳入赔偿法即应增加的赔偿范围、确认的进一步规范以及赔偿决定执行难等有争议的问题进行了探讨，从而引发我们进一步的思考，旨在期待一部完善的赔偿法律的诞生。
