变迁、困境、突破与挑战——新中国成立后我国农村土地权利机制研究

新中国成立以后,我国农村土地所有权和经营权经历了一系列变迁,形成了当前我国农村土地归集体所有,而土地经营权归农户家庭所有的家庭联产承包经营责任制。但是,随着改革开放以后经济的高速发展,我国已经进入一个城市化急剧扩张的时期。这一时期,农村土地所有权和经营权中的一些深层次矛盾逐渐凸显出来,日益成为我们当前必须要解决的问题。党的十八届三中全会对我国农村土地政策进行了新的论述,既体现了土地政策的稳定性,又为解决当前矛盾提供了一些新思路,既具继承性又具创新性,是我国农村土地权利机制变迁中的一项突破。

Change,Dilemma,Breakthrough and Challenge:the Rural Land Rights Mechanism since 1949

After the founding of the People＇ s Republic of China in 1949,China＇ s rural land ownership and management rights have undergone a series of changes and formed the current household contract responsibility system in which China＇ s rural land is of collective ownership and the land management right belongs to the family.However,with the rapid development of economy after the implementation of the reform and opening up policies,China has entered into a period of rapid urbanization.In this period,Some deep-rooted contradictions in rural land ownership and management rights are increasingly prominent and must be solved.The Third Plenary Session of the 18 th CPC Central Committee re-defined China＇ s rural land policy,which reflects the stability of land policy and provides a new way to solve the contradiction in question.This is a breakthrough in our rural land right system.
