| 摘 要： | 当人们被迫使用暴力性私力救济的同时,暴力也毁灭了生活。文章从结构的角度对暴力性私力救济进行法律社会学考察,发现政府保护性职能的缺失、司法腐败、不同纠纷解决机制之间的合作缺失严重制约了人们获得有效的公力救济,是引发暴力性私力救济的结构性原因。通过对公力救济系统的完善和改造,可以有效治理暴力性私力救济。

| Abstract: | Violence with which people have to seek self-help will destroy their life. The article focuses on a legal-sociological study on violent self-help from the perspective of structural factor, which demonstrates some structural factors to cause occurrenc of violent self-help: loss of protective function of government, judicial corruption, loss of cooperation among different settlement mechanisms of dispute. Violent self-help can be ruled effectively by improving and perfecting official help systems. |
