| 摘 要： | 到目前为止,犯罪是否必有犯罪对象仍在争论之中,而犯罪对象如何体现犯罪客体则少有关注,至于犯罪对象是＂具体的＂人或物还无人质疑。犯罪是否必有犯罪对象应从本质与表象的关系等角度给予回答,而随着社会的发展,特别是高科技的迅猛发展,犯罪对象已出现＂无形物＂这一新成员。有犯罪必有犯罪对象,无犯罪对象必无犯罪。犯罪对象对犯罪客体的体现有其特定的前提,犯罪对象体现犯罪客体的途径是状态影响或改变性。
