TRIPs协议下东盟专利法协调的困境与出路

20世纪90年代中期，东盟开始加大各国知识产权领域的合作以消除成员国之间的贸易障碍。1995年12月15日，东盟各国在泰国曼谷通过了《东盟关于知识产权保护合作的框架协议》（以下简称TRIPs），正如该框架协议的序言部分所言，东盟承认知识产权在成员国之间的贸易和投资领域以及区域合作中扮演重要角色，期望在知识产权和相关领域内加强更紧密的合作，以便为经济合作提供坚实的基础，迅速实现东盟自由贸易区和东盟成员国的繁荣。

Straits and outlet of the ASEAN Cooperation in the Field of Patent Law under the TRIPs Agreement

The ASEAN Cooperation in the field of Patent Law was located on the high standards of the TRIPs agreement, but this cooperation has failed to achieve much progress in the past 12 years. The patent systems disparities of member states is relatively great and operated independent, for some of them, the compliance nf TRIPs agreement is still facing difficulties. The way out for the ASEAN is to adopt the inner transitional regional standards and achieve coordinated goal by stages.
