我国个人破产制度构建初探

破产制度是市场经济法律体系的重要组成部分。作为破产制度发端的个人破产制度,更应该被规定在破产法律规范中。随着改革开放和经济的不断发展,无论从理论上还是在现实中,我们都急需一部个人破产法,而且,我国现在也已初步具备了建立个人破产制度的条件。我们应借鉴国外的个人破产立法,结合我国的实际情况,尽快建立我国的个人破产制度,使我国的破产法律制度逐步完善,逐步与国际破产法律的发展接轨。

Explorations on the Construction of Individual Bankruptcy System in China

Bankruptcy system is an important part of market economic law system.As the beginning of bankruptcy system,individual bankruptcy system should be put into the bankruptcy law.With the further development of economy and the conduction of reform and opening-up policies,theoretically or practically,we urgently need a law for individual bankruptcy.Further more,we have established the conditions for the law in China.We should,based on the practical situation in China,refer to the overseas bankruptcy law and issue our own individual bankruptcy law,so as to gradually perfect bankruptcy law in China and adjust to the international development in the field.
