受贿罪立法完善之设想

如何修改受贿罪以更好地与《联合国反腐败公约》衔接，更有力地打击贿赂犯罪的讨论由来已久。文章从我国受贿罪的立法规定与打击受贿罪的实际需要出发，提出了我国现行受贿罪的立法缺陷，并结合《联合国反腐败公约》的有关内容和其他国家有关受贿罪的立法规定，提出了扩大受贿罪中“贿赂”的范围、取消“为他人谋利益”的构成要件及构建定罪量刑二元标准的立法建议。

Assumption on Consummating Legislation on the Bribery Crime

It has been discussed for a long time how to amend bribery crime to link with＂UN＇s Convention on Anti-bribery＂ better and to defeat bribery crimes. In this paper, from the legislative regulation and judicial practice, the author put forward the flaw of current criminal law. Furthermore, on the basis of taking the ＂UN＇s Convention on Anti-bribery＂ into consideration, the author advised that we should enlarge the scale of bribe crimes and abolish the element of committing for other＇s behalf so as to build binary standard legislative system.
