裁判依归：公正性与可接受性之博弈

裁判的目的在于＂定分止争＂,而要达到＂定分止争＂之效,则需依赖于裁判公正性与可接受性二因素的共同作用。裁判公正性乃立足于法律规范之内的标准,是为法律标准,裁判可接受性则为法律规范之外的标准,是为社会标准。裁判公正性与可接受性时而同向相携,时而背道而驰。在规范底线之内协调公正性与可接受性,实为有益之举。

The Value-orientation of Judgment: Gamble between Justice and Acceptability

The aim of judgment is to reasonably dissolve disputes and smooth arguments.Any judicial decision shall rely on justice and acceptability both so that the aim so-called can be achieved.Justice is lawful standard,which is included in legal items while acceptability stands out of law,which represents more complicated and mutual-infected factors and is social.The two factors above struggle sometimes while reconcile sometimes.To make every effort to reconcile the two factors in range of laws is beneficial.
