| 摘 要： | 从一定意义上讲，法律的人性化构成了法律的价值基础。“亲亲相隐”制度恰恰抓住了人所具有的悲悯之情，为刚硬的法律注入了人性魅力，使法律理性和天然人性实现了有机统一。它为修正我国刑事法律的人性匮乏提供了实证支撑。

| Abstract: | It is true to state that the basis of the laws's value is its humanity.Being passed from generation to generation,the system of tolerating and concealing between kinfolks falls for human's commiseration and provides a humane charm for the rigid law,which in the end makes the reason of the law and the natural humanity exist harmoniously.The system of tolerating and concealing between kinfolks offers a support for amending the insufficiency of the humanity in the Chinese penal laws. |
