论少数民族习惯法的生态本原

摘    要:任何一个民族的生存都依赖于一定的环境。可以说一个民族的发展史就是一部如何适应环境的历史。一个民族既然是在一定的环境中生产和生活,那么其全部的生产活动以及部分与生产或维持生活有关的行为规则,就可以看作是直接或间接适应环境,求得生存和发展的一种手段。但是与其它动物不同的是,人不是用改变自己机体或行为的办法去消极地适应环境,而是用改造环境的方法去主动的适应环境。在这一长期过程中,一个民族在与环境以及人们之间互动中逐渐生成了适应环境,求得生存和发展的行为规则——民族习惯法。因而民族习惯法是在生产与生活中自发形成的,是一个民族世世代代累积的经验的总结,而不是有目的的、理智的创造物。贵州少数民族习惯法的生成有其特定的生态本原。

Abstract:Any nation has to rely on certain environment in order to live.We can say that the development of a nation is the history of its adaptation to the environment.Since a nation lives and produces in certain environment,all its production and part of its rules about production and living may be regard as direct or indirect adaptation to the environment and a means of living and development.But man differs from animals in that man does not change his organism or behavior to adapt to the environment passively but uses a method of remaking the environment to adapt to the environment actively.During this long period of time,a nation develops its rules which adapts to the environment,living and development.So law is developed automatically in production and life and is the summary of a nation's experiences which pass on from generation to generation.It is not a purposed or rational creation.The development of customary law of Guizhou's minority has its own special ecological source.
