论实行行为终了的判断与中止行为类型的划分

实行行为终了与否的判断标准问题,不仅直接关系到中止行为类型的划分,而且还间接影响到不同类型中止犯的认定标准。在德国,关于实行行为终了与否的判断标准,存在行为计划说、个别行为说以及全部行为说等学说。在日本,则存在主观说、修正的主观说、客观说、遮断说以及折衷说等不同见解。其中,全部行为说和折衷说较为可取。在我国,对行为是否实行终了的判断也应采折衷说,即应与是否需要采取积极措施防止犯罪结果发生以及行为人的主观认识内容联系起来作出判断。
