船舶登记法律制度的经济分析

船舶登记法律制度具有重要的法律和经济功能。通过经济分析,本文认为,应对我国现行的有关法律重新整合,并对开放登记提出对策建议。同时本文认为,未登记的权利能否对抗第三人应由第三人决定,赋予第三人选择权是效益与公平和谐统一的要求。

An Economic Analysis on the Legal System of Ship Registry

The legal system of ship registry plays very important legal and economy roles.This paper suggests that the enforceable laws and regulations relevant to ship registry should be integrated anew.The author also puts forward countermeasures upon open registration of ship.This paper also draws a conclusion that whether or not the rights in ships unregistered shall act against a third party depends upon the third party's choice.And the third party's right of choice meets the requirements of harmonious coherence of benefit and equity.
