| 摘 要： | 刑法、刑事诉讼法和有关司法解释对刑事附带民事诉讼作了专门规定,但仍不完善。应在附带民事诉讼当事人的范围、举证时限、赔偿范围的确定和同案犯在逃的附带民事诉讼问题上加以完善。
