| 摘 要： | 现代赦免制度具有极其独特而重要的意义，我国当前的赦免制度存在较大缺陷，从赦免制度的立法现状并结合当前我国的基本国情通盘考虑，我们应当从实体和程序两方面完善我国的特赦制度进而利用其独特的机能，为构建社会主义和谐社会服务。

| Abstract: | Modern remission system is of extremely unique and important significance,while country's current remission system has some comparatively obvious defects.Based on the current legislative situation of remission system and our country's basic condition,we should perfect our country's remission system from such two respects as entity and procedure,so as to take advantage of its special functions to serve the construction of harmonious society. |
