In regard to the differences as to the properties and legal status of the third party in the state the art in the present academic field and judicial practice, the present paper discusses the relationship between the third party with independent claims and the accusing party, the relationship between the third party without independent claims and the accusing party, the differences between the third party and the co-litigation party and those between the third party without independent claims and the witness.
