| 摘 要： | 在漫长的历史长河中,我国一直存在可能的司法解释传统,并已建立现代的司法解释制度。然而由于我国的司法解释制度与西方的司法解释制度的内涵不同,同时出于对权力滥用的警觉,导致我国的司法解释制度深受质疑。但司法解释制度弥补现实立法不足的功能却要求司法机关在被动、消极裁决的同时能动地进行司法,在完善司法解释制度的过程中对司法解释的空间进行必要的拓展。

| Abstract: | In the long history, there has been a probably tradition of judicial interpretation in China, which has established a modem system of judicial interpretation. However, due to the different meanings between China＇s judicial interpretation system and the western judicial interpretation system, and the concerns about abuse of power, China＇s judicial interpretation system has been challenged. However, the function of judicial interpretation, which makes up for the lacks of practical legislation, requires the judiciary adjudge actively. As a result, in the process of improving judicial interpretation system, we should expand the Space for judicial interpretation. |
