| 摘 要： | 刑法第263条规定了抢劫罪的八种适用重刑的情形,司法实践中对其中的"入户抢劫"有不同的理解,从而导致了量刑的不适当.只有严格区分"户"与"室"的不同,正确理解"入户抢劫"的含义,才能做到量刑适当,避免罚不当罪.

| Abstract: | The 263rd item in Penal code gives eight situations of the heavy penalty to the crime of robbing, and robbing into the home is one of the situations .In judicatory practices the crime of robbing into the home has caused the different comprehension, and so caused unsuitable measurement of penalty. We must distinguish the home from the door, and understand the content of the crime in order to avoid unsuitable measurement of penalty. |
