关于人格权概念的质疑与反思

本文立足于学界存有的对人格权概念可能性、必要性、不确定性质疑而为反思立论。文章经论说认为,人格权作为权利构建在逻辑上是可能的,其于实证法上确立是合理且必要的,至于人格权概念的不确定性,不能否认也不应不适当放大,而应尽力通过理论研究与法律实践去减少其不确定性。

Inquiry and Reflections on the Concept of the Personality Rights

Based on the enquiry and reflection on the concept on the personality rights concerning the possibility,necessity and uncertainty thereof,this dissertation holds that the establishment of the personality rights is feasible in logic and necessary in practice.It is suggested to reduce the uncertainty of the concept through theoretical study and legal practice,with a neutral attitude,neither negative nor inappropriately positive.
