刑事撤案若干问题研究

司法实践中,刑事撤案并不如刑事立案那样受重视,存在着撤案即错案、撤案不当、撤案不及时等一系列问题。要解决这些问题,就必须正视刑事撤案机制中存在的法外司法等打擦边球的隐性司法的做法,进一步明确撤案的本质,建立科学的衡量侦查质量的考核体系;对司法实践中检察机关建议公安机关撤案的不合法律规定的做法,予以坚决禁止;建立起完善的刑事撤案监督制度,从理念到立法,规范刑事撤案制度的相关问题。
