| 摘 要： | 世界主要国家都以特别刑法模式对矿产资源的刑事规范给予了制度化,并确立了资源和生态环境的双重法益;这对我国调整刑法结构,确立经济刑法的理念提供了有利参考;国外矿产刑事制度中的资格刑、无过错刑事责任制度也为我国在该领域奠定了立法创新的基础。非法采矿设备的刑事处置、日益严重的战略资源走私、资源与环境紧密结合的自然特点等现象为我国矿产资源刑事立法构筑了新视角。
