Abstract: | The current system of nursing home regulation, focused on prescriptive regulations and a punitive approach to compliance, can be described as “the worst of all worlds.” The approach is both burdensome to the industry and ineffective in protecting consumers. This article proposes an alternative model for nursing home regulation, focused on co‐regulation (the use of private accreditation agencies) and deregulation (the repeal of state certification of need laws). |
