| 摘 要： | 最高人民法院《关于民事诉讼证据的若干规定》中类似＂告知＂、＂说明＂的条文有多处具体规定,这是我国司法机关第一次以司法解释的形式赋予法官行使阐明权的法律制度。文章对阐明权的行使范围、原则、方式、阶段和不当行使的救济等问题进行了分析和探讨,以期对司法实践有所裨益。

| Abstract: | There are some special regulation in the articles with the words like explain and inform in several rules of civil procedure evidence published by highest people's court.This is the first time that judicial authority publishes judicial explanation to set up power of inquire.The article analyzes the range,principle,form and stage of application of power of inquire,in hopes that is good for judicial practice. |
