| 摘 要： | 单位商业受贿犯罪无须整体证明单位利用职务上的便利,但须局部证明有关直接责任人员利用了商贸经济活动的运作性、管理性、交易性权力。直接责任人员的商业贿赂行为、意志及由此产生的定罪与量刑,不能脱离所属单位的特征、性质而存在。

| Abstract: | To identify working business bribery, we need to clarify whether the related direct principal takes advantage of commercial operation, management and trade rights instead whether the company takes advantage of their duty convenience. The conviction and sentencing of crimes' action and purpose are based on the characteristic and nature of their companies. |
