| 摘 要： | 网络环境下知识产权的犯罪主体更广泛,犯罪目的更易得逞,危害后果更严重。同时,网络环境下知识产权犯罪刑法理论在危害行为、犯罪目的、客体对象、危害后果等方面都面临新的挑战。目前在刑法保护的应对方面存在着法规法律之间的内在矛盾与越权等问题,建议通过修改立法模式、修正刑法规范、完善司法解释等方式予以解决。

| Abstract: | The harmful consequences of intellectual property rights crimes in the network environment are more serious,and criminal purposes are easier to reach.There exist inner conflicts inside the laws,and excess of power. It is suggested that the legislative model and criminal norms be revised,the judicial interpretation be perfected. |
