| 摘 要： | 共同犯罪中的片面共犯一直是刑法理论界争议较大的话题。对于片面的共同犯罪不应以相互的联系为必要 ,只要符合片面共犯的构成要件就可以成立。承认片面共犯的存在 ,对于完善我国的共同犯罪理论、打击违法犯罪分子 ,其作用不可忽视。

| Abstract: | The issue of one-sided accomplice in joint offense has been discussing in the theory circle. The relationship among offenders should not be considered a necessary constitute. if some conditions are in accordance with one-sided accomplice, the crime can be convicted. It will produce helpful influence to identify the one-sided accomplice for improving criminal theory and combating the offenders. |
