关于开展"严打"整治斗争的法律思考

我国当前结合社会治安形势和刑事犯罪情况做出“严打”整治的决定是一项重要的刑事政策,必须在法治轨道上运行。进行“严打”整治斗争,要充分认识它的产生背景、对象、特点与核心。“严打”整治对象范围要严格依照规定,不能任意扩大;“严打”整治之从重从快,要受到刑事诉讼法立法精神和具体规则的约束。正确把握“两个基本”原则的内涵,并应用于司法实践。
