| 摘 要： | 本文就近现代国际私法发展史上对萨维尼的“法律关系本座说”的继承与批判 (即扬弃 )进行了阐述。作者认为 :近现代国际私法把“法律关系本座说”推置于一个基础、核心的地位 ,在继承的基础上加以发扬 ,在批驳的基础上予以完善 ,萨维尼能在一个世纪以前提出至今仍具深远影响的“法律关系本座说” ,实乃功不可没。
