试论人权的法律保障

我国2004年3月14日宪法修正案首次将人权概念庄严地引入宪法,明确规定国家尊重和保障人权,这为人权的实现提供了宪法保障,开创了中国用宪法保障人权的新时代。人权具有普遍性,又具有特殊性。尽管我国的人权状况比以前有了很大的改善,在国内法律中都有对人权保障的内容规定,但国内相关法律对人权的保障仍然存在着一些问题,应不断完善宪法、刑法、行政法、刑事诉讼法的内容,来切实保障人权的实现。
