| 摘 要： | 物权法首次确认了公产与私产平等保护原则，是宪政中保护财产权原则的体现，也是宪政人权保障原则的落实。从宪法学角度来看，物权法的制定有其独特的宪法依据，其颁布实施也将促进我国宪政建设，对宪法相关条款的修改和《国有财产法》的制定也会产生深远影响。

| Abstract: | The Property Law confirmed the principle of equality in public property and private property for the first time, which reflects the principle of property right protecting and human rights guaranteeing. It discusses the constitutional rules of the property law making and the significance to the construction of constitutional government in China. At last, it puts forward some suggestions for the revision of the Constitution and the draft of the State Property law. |
