| 摘 要： | 辩诉交易制度的背景、实践以及诉讼主体行为均有其自身的特点。从法律经济学的角度来看,辩诉交易制度能够提高刑事诉讼的经济效益,但却不能取代公平正义而成为诉讼的最高价值。同时,它与当事人主义的对抗制诉讼存在着内在的有机联系。
