论电子政务信息公开与隐私权冲突之协调

信息公开是电子政务的重要方面,是公众知情权的保障。但是信息公开不可避免的给个人隐私造成侵害,在分析我国隐私权保护现状的基础上,笔者提出应采用利益衡量和权利限制原则,并借鉴欧美的经验,构建安全港模式,从而实现电子政务信息公开与公民隐私权保护两者的利益平衡。

Coordination on Conflicts between the Right to Know and the Right of Privacy in Information Disclosure of Electronic Government

This article puts forward that the information disclosure is the significant aspect of electronic government in protecting the public right to know. However the information disclosure inevitably invades the individual's right of privacy. So the author believes that according to the interests balancing principle and the right restriction principle, on the base of absorbing of the experience of EU and America, constructing a safe harbor model is an effective method to balancing the interests between the electronic government and citizen's right of privacy, after analyzing the actuality of protecting the right of privacy in China.
